Legislated changes to patient access to pathology results in My Health Record 1 July 2026
From 1 July 2026, new national "Share by Default" legislation will require most pathology results to be uploaded to My Health Record shortly after they are released, unless a defined exception applies.
This means patients may be able to see their results before speaking with their doctor or healthcare provider.
What is changing?
PathWest is implementing this legislated change and raising awareness with hospital and community clinicians and patients ahead of commencement.
- Patients may view results before clinical follow‑up
- A 5‑day legislated delay applies only to:
- Anatomical pathology
- Cytopathology
- Genetic testing
Patient choice
Patients can:
- Opt-out of My Health Record
- Restrict or remove specific results
Results will be shared unless patients opt-out or restrict access
What this means for patients and clinicians
- Patients may view results without clinical context, which can sometimes lead to confusion or concern
- Patients may seek information or reassurance before their scheduled appointment
Supporting patients
Clear communication about test results and what they mean is an important part of patient care.
- Patients are encouraged to speak with their treating clinician about their results
- Reassurance that their clinician is best placed to interpret results can help support understanding and confidence
